Concept Education — Terms & Conditions

By enrolling in Concept Education (we/our/us) tutoring services, you (the Student and/or parent/guardian) agree to the following Terms & Conditions. These terms and conditions set the expectations for service delivery, responsibilities, conduct, and limits of liability.
If you disagree with any part of these terms, please do not proceed with enrolment.
1. Parties and definitions
- Who we are. Hall Education Pty Ltd, ACN 690 854 623, ABN 32 690 854 623, trading as Concept Education Co. ("Concept Education", "we", "us") provides online tutoring services to parents/guardians and students ("you").
- Our Services. We offer one-to-one and group tutoring for students delivered online, as well as membership services including a Concept Study Club.
- Key terms. ‘Tutor’ means a person engaged by us to deliver sessions. Student means the person receiving tutoring. ‘Session’ means a scheduled lesson booked through our platform. ‘Enrolment’ means a recurring package or subscription (if applicable).
2. Your contract.
When you book a Session or Enrolment, you enter into a contract with Concept Education. Tutors deliver the Session on our behalf.
3. Our safety measures.
Every Tutor engaged by us holds a current NSW Working With Children Check (WWCC) verified by us before their first Session. We also verify identity and review qualifications/experience based on documents provided. Concept Education reviews a sample of lessons conducted to support tutor development and ensure a positive learning environment.
4. Outcomes.
While we take reasonable steps to assess tutor suitability and to support tutors, we do not guarantee a particular outcome measured by grades or other metrics. Successful tutoring requires the student to attend Sessions, apply themselves, and do their best to implement feedback. Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the Australian Consumer Law.
5. Your responsibilities.
- Collaboration. Successful tutoring requires the Student to apply themselves and do their best to implement feedback.
- Information. You must share accurate information with the tutor about assessment dates and learning needs. You must notify Concept Education of any special needs or learning adjustments prior to enrolment.
- Age. You hereby confirm that you are not less than eighteen years of age. Any person seeking to use our Services who is less than eighteen years of age must arrange for a parent or guardian to register with us on their behalf, and that parent or guardian will be the Client for the purposes of these Terms.
- Online delivery. Sessions are delivered online. You must ensure the Student has a suitable device, a camera, a microphone, and a stable internet connection. The Student’s learning environment must allow appropriate concentration. If technology issues prevent delivery of a Session, we may work with you to reschedule a suitable time.
- Attendance. Successful tutoring is supported by routine, accountability and consistency.
- Starting on time. The Student must enter the online Session at or before the start time. Sessions end at the scheduled time. If the Student arrives late, the Session will still end at the scheduled time and the full fee applies. Tutors will remain available for 10 minutes after the start time. Beyond this time, the lesson will be treated as a no-show.
- Student no-show. If the Student does not attend and the booking was not cancelled in time (see Cancellations), the fee is forfeited. One grace credit per Student per term may be issued for an unforeseen emergency if you notify us on the day.
- Cancellations of packages and subscriptions by the Student.
- Enrolments. Where a Student elects not to continue tutoring after the first session, we will refund the package other than the first Session.
- Subscriptions and memberships. Where a Student cancels a subscription payment or their membership for a product or service, periods will not be refunded pro-rata.
- Cancellations and rescheduling of Sessions by the Student. You may cancel or reschedule a Session via your online Concept Education account or by direct contact with the tutor.
- 24 hours notice or greater: no charge.
- Within 24 hours: the Session fee is payable.
- Cancellations and rescheduling by Concept Education or the Tutor. If a Tutor is unavailable or we otherwise cancel a Session, we will offer you a rescheduling of the lesson for no additional fee (a credit). In the unlikely event that a pattern of cancellations occurs, we may reassign the Tutor in consultation with you, or refund the remainder of your package if we are unable to deliver the service.
- Emergencies/illness: contact us as soon as possible to allow rescheduling, rather than a no-show. In line with our attendance policy above, we may issue one grace credit per term to allow for emergencies. Credits expire after 90 days.
- Conduct. We expect respectful behaviour from Tutors and Students. Bullying, harassment, hate speech or inappropriate content is not permitted. Report concerns to us immediately.
6. Subscriptions and memberships.
If you purchase a subscription (recurring package) or membership of a product or service, charges recur each billing cycle shown at checkout. You may cancel any time effective at the end of the current billing period. We will provide any prepaid Sessions remaining in the current billing period, or if we cannot reasonably provide them, we will refund or credit those Sessions. Price changes will be notified at least 14 days in advance and will apply from the next billing cycle.
7. Learning materials.
All lesson resources we provide (including worksheets, recordings if any, and platform content) are owned by Concept Education or our licensors. We grant you a non exclusive, non transferable licence to use these materials for the Student’s personal study. You must not copy, distribute or commercialise them without our permission.
8. Student work.
The Student owns their own work. You grant us a licence to use anonymous excerpts solely for quality assurance, tutor training and marketing purposes.
9. Group sessions.
As far as possible, we seek to provide group Sessions at a consistent day and time each week. We may offer up to one grace credit per term for missed sessions in accordance with our cancellation terms. Otherwise, missed group Sessions are not refundable but we will provide any materials and notes if relied upon during a group Session. To protect Student privacy, we do not provide recordings of group sessions.
10. Non solicitation of Tutors.
You agree not to engage a Tutor introduced by us to provide tutoring outside Concept Education during your contract and for 6 months after your last Session with that Tutor. Tutors are not permitted to engage in tutoring outside of Concept Education while working with us.
11. Conduct & Respect
- Respectful language and behaviour are required. We expect parents, Students and Tutors to interact professionally. Abusive, discriminatory, violent or threatening behaviour will not be tolerated and may result in immediate termination without refund.
- We ask families to respect Tutors’ time and privacy by communicating via official channels only. This means using the tutor's Concept Education email address or directly with the Concept Education team [email protected].
12. Privacy.
We collect personal information to set up your account, take payments, match Tutors and deliver Sessions. Our Privacy Policy explains what we collect, how we use and share it, overseas storage, how to access/correct your information and how to complain. By using our Services, you consent to the handling of personal information in accordance with that policy. We use reputable service providers to deliver video conferencing, scheduling, and payment services, which may process information outside Australia. We comply with the Australian Privacy Principles and the Notifiable Data Breaches scheme and will notify you if a data breach is likely to cause serious harm.
13. Session recordings.
Sessions may be recorded for quality assurance. Recordings are stored securely for up to three months. By engaging in our Services, you consent to these recordings.
14. Liability.
We supply the Services with due care and skill. We do not warrant or guarantee that the student will achieve specific academic outcomes, exam results, rankings, university admission results or career outcomes. To the extent permitted by law, our liability for failure to comply with a statutory guarantee is limited to supplying the Services again or paying to have the service supplied again. To the fullest extent permitted by law, Concept Education, its Tutors, officers and employees are not liable for any indirect, special, incidental or consequential loss arising from tutoring services, including but not limited to lost study time, exam outcomes, missed assessments, or reliance on advice provided. Concept Education is also not liable for any loss, damage, or inconvenience resulting from participation or the consequences of advice, guidance, or study strategies given by Tutors. You agree to indemnify and hold Concept Education harmless against claims arising from misuse of materials, sharing of resources, or breach of these terms. Nothing in these Terms excludes liability that cannot be excluded by law.
15. Payments.
Session fees are shown at booking. Payment is taken in advance by card/direct debit via our payment processor, or via direct debit. Keep your billing details current. If payment fails, we’ll notify you and may pause Sessions until the issue is resolved. For Enrolments, charges recur each billing cycle. All amounts are in Australian Dollars and include GST where applicable. All payments are made directly to Concept Education. Tutors are not able to accept direct payment. Receipts/tax invoices are issued electronically.
Study Club Member Benefits
- All paying Study Club members receive 10% off their first tutoring package when they enroll in 1:1 tutoring. The 10% discount applies to the first tutoring package only.
- Current 1:1 tutoring students receive Study Club access at no additional cost, but are not eligible for the 10% discount on any tutoring packages
- After completing 1:1 tutoring, students may continue with Study Club as a standalone option and are required to pay the monthly or annual subscription.
- On the annual study club subscription there is a 30 days trial period in which time you can cancel without cost
16. Complaints and disputes.
Contact coordinator (@) concepteducation.com.au with any concerns. We aim to resolve complaints in good faith within 10 business days.
17. Governing law & venue.
These Terms are governed by the laws of New South Wales, Australia. You agree to the non-exclusive jurisdiction of the courts of NSW.
18. Changes to these terms.
We may update these Terms by posting the new version on our website. If a change materially reduces your rights for an ongoing Enrolment, we will give at least 14 days’ notice, and the change will apply from your next billing cycle.
19. Severability.
If any part of these Terms is invalid or unenforceable, the rest remains in force.
20. Entire agreement.
These Terms, together with any specific details shown at checkout and our Privacy Policy, form the entire agreement between us.
